When i marry my fiancee in October, I will lose my wonderful medical insurance. I am worried because I have a lump in my neck (possibly lymphoma) and if I get it diagnosed now, it could be considered a pre-existing condition. I was wondering if anyone knew if the Health Care Law that was passed in 1997 about pre-existing conditions extends to dependents??? I know that now employers can't deny you coverage for a pre-existing condition if you had med. insurance 60 days or less prior to getting on their insurance policy. I have had my medical insurance through my father for all the years I've been alive (22 years) and the insurance is Tricare. Does this clause apply to dependents as well?

Miss_Melanie_2,
I'm not sure specifically about your case. I do know that some states have insurance for people in transition, such as your case. Consider looking to see if your state may have something like this to help evaluate this lump. For all we know, it could be something totally benign. Anyone else have any comments. Best wishes,

I just had this conversation with an isnurance broker yesterday. That law looks at your "creditable coverage." So, since you HAD insurance coverage from your dad, it is still considered coverage. Your husband's insurance cannot consider your condition pre-existing if you had insurance coverage for the past two years without a break. Even if they were able to, it would be limited to excluding coverage for only the first 6 months, I think. Go to this website:

http://www.dol.gov/ebsa/faqs/faq_consumer_hipaa.html

It gets more complicated than that if you had a break in coverage, but that should put your mind at ease.
