Until I can get the POA papers on my Dad which is on Monday, does any know who can and how is a person deemed incapable of making decisions based on having a brain tumour?

My Dad can still answer questions - quite well but is very silent. He doesn't start conversation but will answer questions. I'm wondering if a doctor is the person who needs to make the judgement.

Any thoughts would be great.
